FACTS. - A robber stuck uncocked pistol in his belt, and fled. A gunshot was soon heard, and a bystander saw a man dressed like Griffiths limping. Griffiths was treated the next day for a gunshot wound in his foot, for which the explanation proffered by him and his friends was not entirely consistent. At trial, all four victims identified Griffiths as the robber, but only three had been able to pick him from a photo array and only one could identify him in a lineup. Griffiths had changed his appearance.
